Website Terms & Conditions
Last Updated: 20th October 2026
These Terms & Conditions ("Terms") govern your use of our Website and any purchase of our Website Clarity Audit and its accompanying PDF report ("the Audit"). By accessing the Website or placing an order, you agree to be bound by these Terms.
1. Information About Us
The Website is operated by Roaring Forties Limited (trading as Clarity Is Key), a company registered in England and Wales under company number 17218092. Registered address: 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ.
2. Eligibility
To place an order, you must be at least 18 years old and be authorised to act for the business whose website is to be reviewed.
3. Pricing and Payments
- Pricing: The price of the Audit is £495. We are not currently registered for VAT, so no VAT is charged. If this changes, we will tell you before you place an order. We reserve the right to change prices at any time, but the price agreed with you before you pay will not change.
- Payment: Payment must be made in full before the Audit is delivered. Our Website does not currently take payment online. To arrange payment, please contact us at info@clarityiskey.co.uk and we will agree a secure payment method with you.
- Order Rejection: We reserve the right to refuse or cancel any order at our sole discretion, including due to suspected fraudulent activity, unauthorised or illegal transactions, or pricing errors.
4. Delivery
Once payment has been received and your Audit is complete, we will email you a link to download your PDF report. The download link is personal to you and may expire, so please save your copy promptly. The Audit is delivered within the timescale stated on our Website (currently three working days) once we have received payment and the website details we need. We are not responsible for delivery delays caused by an incorrect email address or by spam filters; if you have not received your link, please contact us.
5. Cancellations, Digital Content and Refunds
- Immediate Delivery: Before you pay, we will ask you to confirm that you want us to begin work on your Audit, and to deliver the PDF report, straight away.
- Loss of Right to Cancel: Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you are a consumer and have given the confirmation above, you acknowledge that you lose your 14-day right to cancel once we have begun delivering the digital content or, for the service element, once the Audit has been fully carried out. If you cancel before that point, you may be charged for work already done.
- No Change-of-Mind Refunds: Once the Audit has been delivered, we do not offer refunds, exchanges or cancellations if you change your mind. This does not affect your statutory rights.
- Faulty Digital Content: In accordance with the Consumer Rights Act 2015, if the PDF file is defective, corrupted or does not match our description, you are entitled to a repair or replacement. If we cannot provide one within a reasonable time, you may be entitled to a price reduction or refund. If you have a problem with your file, please notify us at info@clarityiskey.co.uk within 30 days of delivery.
6. Chargebacks and Payment Disputes
- Prior Contact Requirement: Before initiating a formal chargeback or payment dispute with your bank or credit card issuer, you agree to contact us directly to attempt to resolve the issue.
- Fraudulent Chargebacks: We take payment fraud seriously. If you initiate a chargeback that is found to be fraudulent or malicious (for example, claiming a report was not delivered when our records show that it was downloaded), we reserve the right to dispute the chargeback, refuse future services, and seek recovery of the amount owed together with reasonable costs through lawful means.
7. Intellectual Property & Usage Licence
All content on this Website, including text, graphics, logos and images, is our exclusive property. Your Audit report is provided to you under a single-user, non-exclusive, non-transferable licence for use within your own business. You may share it with your own staff, web designers and developers so they can act on it, but you must not resell it, publish it or license it to any other third party.
8. Limitation of Liability
- Nature of the Audit: The Audit is a professional opinion based on a manual review of your website at a point in time. We do not guarantee any particular increase in enquiries, sales, search rankings or visibility in AI search results. Our total liability to you for any claim arising from the Audit is limited to the fee you paid for it.
- Indirect Loss: If you are a business customer, we are not liable for any loss of profit, loss of business, business interruption or loss of opportunity, nor for any indirect or consequential loss.
- Statutory Rights: Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law (including the Consumer Rights Act 2015).
9. Governing Law and Jurisdiction
These Terms, their subject matter, and their formation are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.
